How Can I Expunge a DUI From My Criminal Record in Birmingham?

Under Act No. 2017-414, certain criminal records in Alabama are eligible for expungement.

Before DUI convictions could not be expunged from your record, but that can now be done today under Alabama's new expungement law.

Before you decide to petition the court for the expungement of your DUI conviction in Birmingham, you need to be sure that your offense meets the expungement eligibility guidelines. For DUI cases in Alabama to be eligible for expungement, the following must be true:

  • Outcome 1: Defendant either pleaded guilty to another non-DUI offense, or he or she was found not guilty of the DUI charge
  • Outcome 2: Defendant went to trial and was found guilty of a first time DUI charge, but it was later lowered to “Read Under Advisement”. (“Read Under Advisement” is defined as “the adjudication of guilt that has been withheld pending receipt or conclusion of some matter or requirement.”)
  • Outcome 3: The defendant was participating in a pre-trial diversion program and completed all the requirements, including pleading guilty and the judgment being deferred. (“Deferred Judgment” is defined as “the defendant has entered a plea of guilty or nolo contendere, has admitted the truth of allegations upon which the charges are based, and, with the permission of the court, has been placed on probation.”)

What is the Process for Expunging a DUI in Birmingham?

Beginning in 2017, Alabama courts became permitted to expunge criminal records. The full process of getting a DUI conviction record expunged is as follows:

  1. In the town where you were charged with and then convicted of DUI, you or your attorney should contact the court holding the records and let them know you wish to petition for expungement.
  2. If a hearing is ordered, you or your attorney will be required to attend in order to argue your case.
  3. If you have successfully argued your case, or if you are under “outcome” 2, you can move on to petitioning ALEA for the destruction of your records. You will need to provide them a copy of the court order once you have it.
  4. A certified copy of the order expunging your records must be sent to the prosecutor, police precinct (where you were booked), and agency that arrested you.

  3. Anyone applying for an insurance producer license with the Department of Insurance.
  4. Anyone applying for a license to certify emptions with Alabama Department of Labor.
  5. Anyone applying for any license, permit, or certificate to: (1) act as an attorney; (2) be employed as a pharmacist or pharmacy technician
  6. Anyone applying for a license with the State Board of Public Accountancy.
  7. Anyone applying for a certificate of CPA firm or PA under the State Board of Public Accountancy.
  8. Anyone applying for a license to be a certified public manager with the State Personnel Department.
  9. Anyone seeking employment with law enforcement or a municipal or volunteer fire/ambulance/rescue service.
